Wing On Rewards Terms and Conditions
(Effective from January 2021)

The Wing On Rewards is operated by The Wing On Department Stores (Hong Kong) Limited ("Wing On" or "We" shall be construed accordingly). Your participation in the Wing On Rewards is governed by these Wing On Rewards Terms and Conditions ("Terms and Conditions"). By applying for membership of the Wing On Rewards, you agree that you have read and understood these Terms and Conditions and agree to be bound by them. 

1. Definitions

1.1. In these Terms and Conditions, the following words shall be construed as follows: 

1.1.1. "Wing On Rewards" means the app or such other program or software named as "Wing On Rewards" installed in your mobile device or offered through such other platform or medium as we may determine from time to time and accessed by you.
1.1.2. "Wing On Rewards Member" means a member of the Wing On Rewards.
1.1.3. "Wing On Rewards Membership Account" means your membership account in Wing On Rewards upon your successful registration with the Wing On Rewards.
1.1.4. "ePoint" means the point awarded to you when you make purchases at the Retail Stores based on the net spending amount of the transaction after all special offers or discounts.
1.1.5. "Third Party Service Providers" means third party services providers working with us and/or engaged by us to provide services including (a) data entry (b) customer database management, (c) customer contact and (d) secure data disposal, including Personal Data (as defined below).
1.1.6. "Retail Stores" means stores operated by Wing On in Hong Kong.

2. Registration as Wing On Rewards Member

2.1. In order to be registered as a Wing On Rewards Member, registrants must be aged 16 years old or above and complete the below steps.

2.1.1. Install Wing On Rewards into their mobile device
2.1.2. Complete all mandatory fields in the registration form of Wing On Rewards and click to agree the Terms and Conditions
2.1.3. Verify their phone number by receiving a 4-digit verification code in their SMS inbox from Wing On Rewards

2.2. You warrant that all the information you provided to us upon registration as a Wing On Rewards Member is true, accurate and complete.

2.3. You agree to notify us immediately by updating your personal profile(s) upon change of any of your information submitted to us when you registered as a Wing On Rewards Member. To the extent permitted by law, we shall not be liable for any claim, demand, liability or action resulting from your omission, negligence and/or failure to supply us with your updated information and the accuracy and completeness of those information.

2.4. The information you provided us when you register as a Wing On Rewards Member allows us to provide you offers' information. For details of the ways in which we may use your personal data ("Personal Data"), please refer to our Privacy Policy.

2.5. Wing On Rewards Members are able to start earning ePoints after 15 minutes of the successful completion of the member registration process.

2.6. We have the absolute discretion to refuse and/or revoke registration of any registrant/Wing On Rewards Member and to terminate and/or cancel the registration of any registrant/Wing On Rewards Member for any reason whatsoever.

2.7. The registered information under the current eStamp/ ePoint Card membership account (i.e. previous registered membership accounts of eStamp Card or ePoint Card promotion), upon agreeing with the Authorization and Declaration, will be transferred to the Wing On Rewards account. "Authorization and Declaration" means the agreement to The Wing On Department Stores (HK) Limited to disclose information supplied by you in support of this election of transfer and to enable the relevant department and the service provider to access / disclose relevant information for processing your election of transfer. The service of information transfer is valid till September 30, 2018. It will not be accepted after the date.

3. The Wing On Rewards and Reward Offers

3.1. Subject to point 3.4 herein, one ePoint will be credited to your Wing On Rewards Membership for every actual HK$1 spending transaction amount, i.e. amount after deducting discount at our Retail Stores. ePoints may also be issued on designated promotional products from time to time.

3.2. You must provide your Wing On Rewards membership number to our staff before payment to record your ePoints, otherwise your transaction will not be included for ePoints calculation. ePoints cannot be accumulated after the transaction is completed and no replacement ePoints will be credited. ePoints will be awarded and updated to your Wing On Rewards Membership Account within 24 hours after your purchase. You may check your ePoints balance by logging into your Wing On Rewards Membership Account.

3.3. ePoints calculation cycle is from April 1 each year until March 31 at 23:59 of the following year (both dates inclusive). ePoints not redeemed will be expire on March 31 at 23:59 in the same year.

3.4. Calculation and accumulation of ePoints will not be applicable to certain products and/or services including, but not limited to, purchase of Wing On Gift Certificates, gifts of redemption promotion, plastic bag levy, delivery charge, or such other items which Wing On may specify from time to time.

3.5. We reserve the right to exclude any products or services from the calculation and accumulation of ePoints, in our absolute discretion. Notices of such exclusion will be posted in Wing On Rewards from time to time.

3.6. ePoints are offered upon purchase of goods. In case of returning or refunding the goods, ePoints and redeemed rewards (includes any redeemed or used Wing On e-Cash Coupons or e-Coupons) must be deducted from and adjusted in your Wing On Rewards membership account. If you are entitled to a refund in relation to any goods or services purchased by using a Wing On e-Cash Coupon or e-Coupon (whether in partial or full settlement for the purchase), if your returning or refunding the goods is accepted by us, relevant adjustments will be made to the ePoints in your Wing On Rewards membership account (giving credit to the redeemed ePoints and deducting the ePoints earned for that purchase) when returning or refunding the goods is made. If returning or refunding the goods involved used Wing On e-Cash Coupons or e-Coupons, the refunded amount will be the amount after deducting the Wing On e-Cash Coupons or e-Coupons value.

3.7. Member can get a Wing On Cash Discount Coupon by showing the membership number page of Wing On Rewards to Customer Service Counter’s staff in birthday month. The coupon can be used as HK$100 for purchases of every HK$1,000 (Calculation is based on net amount, and except designated counters and consignment goods). Each account can only redeem for one coupon per year. The Terms & Conditions of Wing On Cash Discount Coupon is contained on the overleaf of the coupon.

3.8. We also reserve the right not only to deduct ePoints from your Wing On Rewards Membership Account but to take all actions which we consider to be appropriate if we suspect that such ePoints were obtained via fraudulent, dishonest means or in such other manner not in accordance with these Terms and Conditions.

3.9. ePoints cannot be exchanged or redeemed for cash.

3.10. The latest 30 ePoint records within the ePoint accumulation period shall be shown under your Wing On Rewards Membership Account.

3.11. We reserve the right to change the benefits, offers and features of the Wing On Rewards program from time to time, without prior notice to you.

3.12. Upon accumulating the necessary amount of ePoints, you may use your ePoints to redeem Wing On e-Cash Coupon or Rewards offers. Terms & Conditions of Wing On e-Cash Coupons and rewards offers are different. ePoints used for a redemption of e-Cash Coupons or rewards offers which subsequently expires will not be refunded.

3.13. We give no warranty or representation in relation to any rewards, redemption products and/or services in connection with the Wing On Rewards program or their suitability for any purpose.

3.14. We shall not be liable for any loss of ePoints or loss or damage suffered as a result of a technical defect or error that prevents us from retrieving information relating to your ePoints balance from our computer systems.

3.15. Benefits, including ePoints issued during one-off promotions will be governed by the rules applicable to the specific promotion, and may expire after the end of that promotion.

4. Safety and Security of Wing On Rewards Membership Account and Password

4.1. If your Wing On Rewards Membership Account encounters any error when logging-in or while in use, you may contact the Wing On Customer Service Hotline 2318 2395.

4.2. It is your responsibility to ensure the safe custody and security of your Wing On Rewards Membership Account and password. If your mobile phone installed with your Wing On Rewards Membership Account has been lost or stolen, or if you have reason to believe that your Wing On Rewards Membership Account may have been used by, or password may have been disclosed to, an unauthorised party and you wish to terminate your Wing On Rewards membership account, please get the form of "Termination of Wing On Rewards Account" at Customer Service Counter at our stores , fill in the information (includes your registered member name, mobile number and membership number) and submit to Customer Service Counter's staff. We will process your request during office hours. Please note that if you terminate your account, the respective accumulated ePoints will be removed within the next 3 working days. After the termination, if you wish to join again, you need to fill in the required information again for registration purpose.

5. Termination of Wing On Rewards Membership Account

5.1. If you wish to terminate your Wing On Rewards Membership Account, please get the form of "Termination of Wing On Rewards Membership Account" at Customer Service Counter at our stores , fill in the information (includes your registered member name, mobile number and membership number) and submit to Customer Service Counter's staff. We will process your request during office hours. Please note that if you terminate your account, the respective accumulated ePoints will be removed within the next 3 working days. After the termination, if you wish to join again, you need to fill in the required information again for registration purpose.

5.2. If your Wing On Rewards Account do not have any transactions in 24 months, your Wing On Rewards Membership Account and ePoints will be expired and forfeited.

6. Limitation of Liability

6.1. Becoming a Wing On Rewards Member you acknowledge, agree and accept that your participation in the Wing On Rewards Program is at your own risk. We shall not be liable for any direct, indirect, incidental, consequential or punitive damage or for damages for loss of profit or revenue arising out of your involvement, enrollment and participation in the Wing On Rewards Program or the use of your Wing On Rewards Membership Account.

6.2. To the extent permitted by law, all information, materials, rewards and/or redemption products and/or services provided and performed in connection with the Wing On Rewards Program are provided "as is" without any warranty of any kind either express or implied including, but not limited to, any implied warranties or implied terms as to title, quality, merchantability, fitness for purpose, privacy or non-infringement.

6.3. We assume no responsibility and shall not be liable (to the extent permitted by law) for any damage or injury arising out of your enrollment, participation and involvement in the Wing On Rewards Program or your use of your Wing On Rewards Membership Account; in connection with any rewards, redemption products and/or services provided in connection with the Wing On Rewards Program; or in connection with any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, interception of online communication, software or hardware problems (including without limitation loss of data or compatibility problems), theft, whether for breach of contract, tortious behaviour, negligence, omission, default and/or under any other cause of action (whether the same was caused by us and/or Third Party Service Providers).

6.4. Without prejudice to any other clauses of these Terms and Conditions, to the extent permitted by law, any liability that we may have to you in connection with the Wing On Rewards Program including your use of the Wing On Rewards Membership Account and/or the redemption of ePoints for rewards and/or products and/or services, which if in any event, our liability to any party cannot be excluded, it will only be limited to the restatement of ePoints and/or the cost of rewards, products and/or services to which you as a Wing On Rewards Member should have been entitled during the relevant period as we may determine in our absolute discretion.

7. Personal Data

7.1. In order for you to become a Wing On Rewards Member, it is necessary for you to provide us with certain mandatory Personal Data relating to you on the Wing On Rewards registration form. If you are unable or unwilling to provide us with complete and correct Personal Data, we may not be able to register you as a Wing On Rewards Member or provide you with some of our products and/or services. It is optional for you to provide any Personal Data which is not mandatory.

7.2. You agree and acknowledge that your data (including any Personal Data) provided for the Wing On Rewards Program shall be used to update your personal profile(s) in any of our rewards programs relating to Wing On Rewards. However, to the extent permitted by law, Wing On will not be responsible for the completeness and accuracy for such data update and you are thereby encouraged to check and update your personal profile(s) of the Wing On Rewards Program and/or our other rewards programs relating to Wing On Rewards whenever necessary. All Personal Data shall be handled in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and Wing On’s Personal Data Protection and Privacy Policy. 8. About ePoints

8.1. Upon payment, customers must present the QR code or membership number to the cashier for earning ePoints. The ePoint balance will be updated within 24 hours. If the QR code or membership number cannot be presented, the ePoints will not be re-issued after payment.

8.2. Wing On NETshop Orders: Only local delivery orders and self-picking up orders at stores are eligible to participate in this promotion (China or overseas orders and corporate orders will not be eligible). Please register the Wing On Rewards app successfully before your online purchase at Wing On NETshop, and input the registered mobile number during online purchase. The ePoints will be effective within 14 business days.

8.3. With every 5,000 / 10,000 / 15,000 / 20,000 ePoints accumulated in their accounts can redeem one piece of HK$25 / HK$50 / HK$75 / HK$100 Wing On e-Cash Coupon at the app's membership account for next purchase. The valid period of the Wing On e-Cash Coupon is 2 weeks upon its redemption (the date of redemption is inclusive).

8.4. The spending for ePoint redemption is based on single invoice. The spending with every HK$1 (calculation is based on net amount) will be entitled to 1 ePoint, whilst less than HK$1 is non-redeemable for ePoint.

8.5. After the redemption of Wing On e-Cash Coupon, the balance of ePoints can accumulate continuously within the valid period. All ePoints accrued will be cancelled upon expiry.

8.6. All accumulated ePoints expiring on March 31, 2024 will remain valid until March 31, 2025. Customers must redeem their ePoints for Wing On e-Cash Coupon within the valid period or otherwise the unredeemed ePoints will be forfeited after expiry.

8.7. ePoints recorded in different Wing On Rewards app's accounts cannot be transferred or combined.

8.8. Wing On e-Cash Coupon: (i) The e-Coupon can be used at any department (except designated counters and consignment goods) on or before the expiry date; (ii) The app's membership page must be presented upon payment and can be used once only. Photocopies will not be accepted; (iii) The e-Coupon can be used for one transaction only. No change will be given for any unused balance; (iv) The e-Coupon can be used for purchases from different counters (except designated counters and consignment goods) at the same time; (v) The e-Coupon cannot be used for Wing On NETshop; (vi) The e-Coupon is not exchangeable for cash and cannot be used to purchase Wing On Gift Certificate and tobacco items; (vii) The e-Coupon is offered upon purchase of goods. In case of returning the goods, the e-Coupon must be surrendered together; (viii) The e-Coupon shall be void upon expiry.

8.9. All personal data given by customers will be used for this Wing On Rewards app registration only and for no other purpose. If agreed upon by customers on the Wing On Department Stores’ Personal Information Collection Statement, information shall be kept for future marketing purposes.

8.10. “Personal Information Collection Statement” To ensure you are well informed of Wing On Department Stores’ latest offers, including any gifts, discounts, benefits and other promotions, please note that Wing On Department Stores will provide you with the information relating to our services. Wing On Department Stores will also provide you with the latest offers from its business partners on various kinds of products or services. Such information could be delivered to you personally through various communication channels by using your registered personal information. If you do not wish to receive Wing On Department Stores’ information, please inform us by writing to rewards_support@wingon.hk together with your name and email address.

9. General

9.1. At times when Wing On Rewards may not be operational (e.g. due to nightly update batches, breakdown of communication networks, electricity networks, etc.), we will take all reasonable steps to ensure that Wing On Rewards will resume service as soon as possible after the scheduled maintenance or breakdown.

9.2. ePoints, offers, benefits and Wing On Rewards Membership Account are personal to an individual member and cannot be transferred and/or assigned to any other person.

9.3. We may provide you with new services associated with your Wing On Rewards Membership Account from time to time, and these new services will also be governed by these Terms and Conditions in addition to any other terms and conditions applicable to the specific services.

9.4. In the event that we plan to terminate the Wing On Rewards Program, we endeavor to give you a reasonable period of notice by posting the notice in Wing On Rewards mobile app, Retail Stores, website or through such other means/channels that Wing On deems appropriate. Rewards not collected by the termination date will be forfeited and will not be refunded/recoverable.

9.5. If you breach or we have reasonable ground to believe that you have breached these Terms and Conditions, we may suspend or terminate your Wing On Rewards Membership Account and/or seek to recover any damages and/or losses to us and/or to Our Partners and/or Third Party Service Providers from you arising from and/or in relation to your breach.

9.6. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, such invalidity and unenforceability shall not affect the remainder of these Terms and Conditions which shall continue in full force and effect.

9.7. Any failure or delay by us to act in relation to a breach of these Terms and Conditions by you does not waive our right to take action in respect of the said breach and any similar breach of these Terms and Conditions by you in the future.

10. Disclaimers of Use of Wing On Rewards

10.1. Information and promotional offers in relation to any goods and/or services will be updated in Wing On Rewards from time to time without prior notice to you. The valid period of any Information displayed in Wing On Rewards is based on our server time. The Information contained in Wing On Rewards is for reference only. We do not warrant the accuracy, completeness, reliability or timeliness of the Information in Wing On Rewards for any reason whatsoever. We shall not be liable to you or any user for any costs, claims, liabilities, losses or damages whatsoever arising directly or indirectly from the use of or reliance on the Information. Use of Wing On Rewards requires compatible devices and mobile data or WiFi access. Your internet service provider may charge any costs incurred by using mobile data or WiFi. Stable-speed mobile data or WiFi access is recommended. Wing On Rewards may be updated from time to time without prior notice and you will have to download the latest version of Wing On Rewards for access to your membership account in Wing On Rewards ("Wing On Rewards Membership Account").

11. Intellectual Property Rights

11.1. Wing On Rewards and any Information available in it including, but not limited to, text, graphics, icons, images, software, source code and trademarks, are protected by copyright, design, trademark and other intellectual property rights owned or controlled by us, our licensors and/or Third Party Service Providers. You may not copy, reproduce, republish, upload, download, post, transmit, store in retrieval system, modify, alter or display in public or distribute in any way the contents or any part of Wing On Rewards for any purpose without our prior written permission.

12. Links

12.1. Wing On Rewards may contain links to other apps, websites and/or webpages which are operated by third parties. We have no control over the content of the linked apps, websites and/or webpages or the way in which the operators of those apps, websites and/or webpages deal with your personal data. You should review the terms and conditions/privacy policy for those third party apps, websites and/or webpages to understand the ways in which your personal data may be used by those third parties and we disclaim all responsibility and liability for any loss or damage that may be suffered by you in connection with the linked apps, websites and/or webpages.

13. Privacy & Security

13.1. For an explanation of Wing On Rewards’ practices and policies relating to the collection, use and storage of visitor’s information, please read our Privacy Policy.

14. Disclamer of Liability

14.1. We do not represent or warrant that Wing On Rewards will always be available and meet your requirements, that access will not be interrupted, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your mobile phone. You have sole responsibility for providing adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for viruses or other destructive properties. We make no representations or warranties regarding the accuracy, functionality or performance of any third party software that may be used in connection with Wing On Rewards. You expressly agree that your use of, or inability to use, Wing On Rewards is at your sole risk. Wing On Rewards and goods and services delivered to you through Wing On Rewards are provided on an "as is" basis and as available for your use, without warranties of any kind, either express or implied, including all implied warranties of merchantability, fitness for a particular purpose, title, and non infringement. In no case shall Wing On, its directors, employees and Third Party Service Providers be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of Wing On Rewards or for any other claim related in any way to your use of Wing On Rewards, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content (or product) posted, transmitted, or otherwise made available via Wing On Rewards even if advised of their possibility.

14.2 We reserve the right to amend the terms and conditions at any time without prior notice.

14.3 Should there be any dispute, the decision of The Wing On Department Stores (Hong Kong) Limited shall be final.

15. English Prevails

15.1. If there is any discrepancy or conflict between the English and Chinese versions of these Terms of Use, the English version shall prevail.

16. Governing Law

16.1. These Terms of Use shall be governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.

17. Privity of Contract

17.1. The contract (Rights of Third Parties) Ordinance shall not apply to your participation in the Wing On Rewards.
